Three-Level Structure of Land Rights

In many countries, both civil law and customary law recognize not only surface rights to land, but also subsurface rights and air rights—those that exist below and above the ground. Subsurface and air rights are, without question, legitimate forms of property rights. The problem, however, lies in the lack of public awareness regarding ownership of these layers. Unless such rights are explicitly registered, they are rarely indicated on official property records, and thus often overlooked. It is also worth noting that under current Korean law, the land registry system does not hold official legal authority (public credibility) in the strictest sense.

Bringing visibility to invisible rights is the first step toward spatial asset innovation.

First, the current land registry system does not carry legally recognized public credibility.
